State Senate Approves (27-12) Statewide Sanctuary Bill SB 54 With Amendments, Advancing It To Assembly

(April 4, 2017) -- As linked on our front page and flashed immediately after the vote, the CA state Senate voted 27-12 on April 3 to approve and advance to the Assembly SB 54, the "Statewide Sanctuary" bill.

Among LB-area lawmakers, State Sen. Ricardo Lara (D, LB-Huntington Park) voted "yes" and state Sen. Janet Nguyen (R, SE LB-Western OC) voted "no."

The measure, amended Mar. 29 (details below) would generally forbid state and local law enforcement agencies, school police and security departments from investigating, interrogating, detaining, detecting, reporting or arresting persons for immigration enforcement purposes. Recent amendments, proposed by SB 54's author state Senate President Pro Tem Kevin deLeon (D, Los Angeles), address some of the issues raised by law enforcement (although three agencies remain opposed, see below).

The amendments: (1) allow local law enforcement to contact Immigration and Customs Enforcement (ICE) and transfer people of ICE, without a warrant, if the person was previously deported for a violent felony; 2) allow response to notification request from ICE and releasing date information if that information is available to the public; 3) allow ICE to interview people in custody or transfer to federal immigration authorities if there is a judicial warrant; 4) clarify that local law enforcement can participate in a joint task force so long as immigration enforcements not the "primary" purpose; and 5) add public libraries to the list of places that are safe zones.
