(Dec. 11, 2006) -- LBReport.com posts the following additional matters pertinent to developments we reported on December 10:
(1) LBReport.com has confirmed that a December 4 letter from Harbor Commission President Jim Hankla to LB Mayor/Council LB Mayor Bob Foster was the subject of a closed session meeting of LB's Board of Harbor Commission, agendized for 8 a.m. Dec. 4 as follows:
CONFERENCE WITH REAL PROPERTY NEGOTIATORS
Closed session pursuant to Section 54956.8 of the Government Code for a conference with real property negotiators regarding the liquefied gas terminal on Terminal Island proposed by Sound Energy Solutions. The Port’s principal
negotiator is Richard D. Steinke.
In response to our inquiry, City Attorney Bob Shannon told LBReport.com that during the closed session the Harbor Commission authorized the letter on a 5-0 vote. [To our knowledge, the voted action wasn't announced after the closed session.]
(2) LBReport.com has obtained a Sept. 21, 2006 letter from two Sound Energy Solutions (SES) executives to LB Mayor Bob Foster, following up on Foster's July 2006 meeting at SES referenced in the Mayor's Dec. 7, 2006 letter to the firm.
The letter, signed by SES President/CEO Tom Giles and VP/COO Rick Hernandez, stated in part:
"We have examined some examples of Port leases as part of our effort to full respond to your request. It appears to us that the very broad language in the Port leases we have examined will provide the basis for us to discuss a commitment on our part to protect the City and Port with respect to the areas of risk that are of concern. We are ready to meet with you and to work with whomever is appropriate to establish the details of our commitments."
