    Denny's On Bellflower/Near Spring Begins 24 Hr Operation With City Hall Approval; Conditions On Other Shopping Ctr. Uses Enacted By Council in '98 Don't Forbid It


    Dennys, June 03(July 1, 2003) -- The Denny's restaurant at the Los Altos Gateway shopping center (Bellflower Blvd. south of Spring St.) has begun 24 hour operation...with City Hall approval.

    The reason is simple: conditions attached in June 1998 by the City Council to re-developed commercial uses on the former Los Altos drive-in site don't forbid it.

    Uses on the Bellflower/Spring southeast corner are governed by a list of conditions approved by the City Council on June 30, 1998. Some excerpts:

    27s: The hours of operation for the fast food restaurants with drive-thru lanes shall be no longer than 6:00 a.m. to 12:00 midnight 7 days a week.

    27u: The hours of operation for the Ford and Chevy dealerships shall be no longer than 6:00 a.m. to 12:00 midnight 7 days a week.

    27y: Deliveries to any of the stores or automobile dealerships shall not be permitted between the hours of 10:00 p.m. and 7:00 a.m. Site access for delivery vehicles shall be prohibited from 10 p.m. to 7 a.m. as shall overnight parking of refrigeration trucks with freezer units operation

    27af: The operating hours for both Major 1 (Big Kmart) and Major 2 (Eagle [now Lowe's] Hardware) will be not later than 11:00 p.m. and not earlier than 6:00 a.m.

    Denny's does not have a drive-thru lane, so the "fast food" limitation (6a-midnight) does not apply...and since the City Council has not limited all night operations citywide, there is no specific prohibition on all night operations at the Denny's.

    However, City Hall still retains a potential hammer: one condition of approval (standard in City Hall conditions) states in part:

    5. ...[I]f the use/operation is found to be detrimental to the surrounding community, including public health, safety or general welfare, environmental quality or quality of life, such shall cause the City to initiate revocation and termination procedures of all rights granted herewith.

    Local Denny's management says they've been open 'round the clock since roughly the first part of June.
