Video Showing Portions Of An LBPD Enforcement Action Re A LB Medpot Outlet Under Review By Department, Percolates Into L.A. News Media; Excessive Force?

(July 4, 2012, 8:57 a.m.) -- A video showing portions of a June 19 LBPD enforcement action against a medical marijuana outlet (300 block of Atlantic Ave., not among 18 outlets allowed by Council action to continue operating until Aug. 12, has been uploaded onto YouTube.com (anonymous source "LongBeachRaids") and came up briefly during Council discussion last night (July 3).

At one point, the video shows an LBPD officer apparently walking on part of an individual seen lying on the floor while being handcuffed. At other points in the video, two individuals (not in uniform) smash video cameras recording the events. The uploaded video is without sound. Time coding on the video acknowledges that it shows segments, not the entire recorded video.

LBReport.com is unaware at this point if LBPD has presented evidence it may have gathered at the dispensary to the LB City Prosecutor's office or whether the City Prosecutor's office has filed charges against the dispensary operator or others.

LAWeekly.com reports that the dispensary owner's lawyer, Matthew Pappas, plans to file a claim on behalf of his client. Its report also quotes an LBPD spokesperson as indicating that that the Department will make a thorough review of what took place.

The police action took place on the same day that the City Council was scheduled to discuss the operations of medical marijuana outlets in Long Beach and related city policies.

The video, webposted on July 2, had been viewed more than 2,400 times by the morning of July 4...and the story has now been picked up by LA's City News Service, effectively making multiple L.A. media outlets aware of it.

The video was mentioned briefly by Councilwoman Rae Gabelich during July 3 Council discussion of her motion to continue to exempt 18 (or 14, figure varies) medical marijuana outlets from a city ban on medpot outlets until the CA Supreme Court rules on LB's ordinance and other marijuana related issues.

Councilwoman Gabelich said (in the context of urging continued exemption from the ban for 18 outlets), "The action that was taken was very offensive to me" and added "I think there's a better way to do it" (arguing for the continuing exemption from the ban; the motion narrowly failed 4-5; LBReport.com coverage here).
