Mayor Garcia Says He's Arranging "City Council Leadership Retreat" To Be Held Locally; No Add'l City Cost He Says; Unclear Who's Setting Agenda; Event Is Legally A Meeting Open To Public Under Brown (Open Meetings) Act


(July 26, 2014) -- Mayor Robert Garcia wrapped up the July 22 City Council meeting by announcing that he's asked the City Council and there "will be" what he described as a "City Council Leadership Retreat" held locally in the coming weeks.

Regardless of how it's described, under CA's Brown (Open Meetings) Act, such an event is legally considered a meeting of a public body and thus must be publicly agendized (date, time, place disclosed, open to the public, compliant with other Brown Act requirements) which Garcia acknowledged.

Mayor Garcia didn't say who's setting the agenda, determnining what topics will or won't be discussed...or potentially inviting Council voted actions.

Garcia said that whether the "Council Leadership Retreat" is held at CSULB or [sounded like] LBCC, it will be done in a way that doesn't bring additional taxpayer burden to the City Council. He added that there'll be more information in the coming couple of weeks.

Under the City Charter, LB's Mayor doesn't have a vote, meaning a Council majority can enable or disapprove actions recommended by the Mayor on items ranging from budgeted spending to policy actions. Six Councilmembers can override a Mayoral veto.
