(June 26, 2013) -- As covered LIVE on LBREPORT.com, the U.S. Supreme Court in a 5-4 ruling this morning dismissed an appeal by Prop 8 supporters and thus let stand a ruling by a fed'l district court judge that struck down CA's Proposition 8 (which barred same sex marriage).
The Court majority ruled that Prop 8's supporters lacked federal court standing to appeal the district judge's order (which struck down the measure) when California elected officials (the Governor and Atty Gen'l) refused to defend the voter-enacted measure. The Court's full opinion is here In a different 5-4 majority, the Court's majority struck down the Congressionally-enacted Defense of Marriage Act (signed into law by then-Pres. Clinton) as unconstitutional. The Court's majority ruled that the statute deprived legally married persons of equal protection under 5th amendment.
