    Here's What The WLB Anti-Gang Injunction Says & Does


    (March 7, 2005) -- So why would a member of a street gang give a rip about an anti-gang injunction?

    Because it could send them to jail for up to six months...and already has brought jail time, says LB Assistant City Prosecutor Dan Murphy.

    The injunction lets LBPD officers arrest gang members who engage in a long list of activities specified in the injunction. For readers' reference, we post a copy of the injunction in pdf form on a link below.

    The LB City Prosecutor's office sought the latest injunction, a strengthened version of previous anti-gang injunctions that now applies to all members of the street gang, not just specifically-named members.

    Superior Court Judge Joseph Di Loreto signed the new order in December 2004...and since then LBPD's West Division has been actively serving West Side Longo members with copies of the injunction, Murphy said.

    Once served, if officers see the gang member doing any of the things that the injunction forbids within the injunction area (bordered by the 710 and Terminal Island freeways and Hill St. and PCH), officers can arrest that person (or have discretion to cite the person with a ticket requiring a court appeareance).

    The charge: violating section 166(a)(4) of the CA Penal Code...which carries up to six months jail time.

    If the case goes to trial, the City Prosecutor's office has the burden of proving beyond a reasonable doubt that the person charged is a member of the West Side Longos; that they violated a term of the injunction and they were served with (put on notice of) the injunction.

    Assistant Prosecutor Murphy says the misdemeanor recently brought 30 days jail time to a defendant plus three years probation that includes agreeing to submit to person and property searches on request by any police officer.

    Murphy said LBPD's West Division began serving gang members with the injunction before the Feb. 24 fatal shooting of Demetrius Williams near Cabrillo High...which is within the injunction area...and LBPD is continuing to serve the injunction on gang members now.

    "It's a tool, and an effective tool, but it's not a cure all," says Murphy. "Ultimately, it will require efforts by the entire community to address this problem."

    The injunction below is for readers' reference. Don't even think about serving it on anyone yourself; leave that to the cops.
