  • (April 3, 2009, updated w/ AQMD documents) -- In connection with the new owner's March 20 removal of vegetation and other operations using a bulldozer on the Loynes-South parcel (between Los Cerritos Channel and mobile home estates), LBReport.com has learned that the South Coast Air Quality Management District (SCAQMD) today issued a Notice of Violation to 2H Construction for conducting operations without a required plan, and excavating a landfill without having an approved excavation management plan from AQMD.

    The agency also issued the a Notice to Comply to add additional cover and compaction to the site to reduce methane emissions to less than 500 ppm.

    In terms of procedures now, SCAQMD Media Office Manager Sam Atwood tells LBReport.com that the Notice of Violation basically directs the landowner to prepare and submit adequate plans that the AQMD says are required. Once that's done, the agency will separately determine what, if any, fines/penalties may be imposed; in effect, the Notice is meant to bring the cited party into compliance.

    The Notice to Comply, which carries a requirement to add cover and compaction and reduce methane emissions to below 500 parts per million, carries an April 17 deadline, Mr. Atwood said. LBReport.com was first to report last month that on March 21, an AQMD inspector responded to the Loynes-south site in response to a complaint from a resident alleging methane odors...and the agency followed up with a second field inspection on March 24.

    As previously reported by LBReport.com, the new owner of the property, Sean Hitchcock, cleared it of vegetation and conducted operations using a bulldozer.

    Mr. Hitchcock told LBReport.com that his actions were in response to a fire hazard abatement advisory that had been sent to the previous owner, Tom Dean (through an LLC entity). Mr. Hitchcock said that Mr. Dean had informed him about the fire hazard abatement advisory prior to Mr. Hitchcock's purchase of the property.
