(March 5, 2012, 3:35 p.m.) -- LBReport.com has obtained a memo from City Hall's Director of Development Services Amy Bodek to the Mayor and City Councilmembers regarding city management's plan to update SEADIP with a Southeast Area Specific Plan (SEASP), a process that would also entail preparation and approval of a Program EIR (an EIR effective for the Plan area for decades), a process used by city management for the recently approved Downtown Development Plan]. File image indicating current SEADIP area In the memo (dated Feb. 29), Ms. Bodek indicates that in addition to seeking grant funding from Sacramento, city staff has met with Lyon Communities, a private development firm which owns the "pumpkin patch" parcel (on the east side of PCH) near the Seal Beach bridge...and Lyon agreed to provide up to $1 million in in-kind services toward preparation of the Specific Plan. Ms. Bodek's memo indicates city staff and Lyon agreed that "all property owners within the Specific Plan area would reimburse their fair share amount as properties develop in the future" and as a condition of the process, Lyon "requested that the city enact a moratorium to restrict new development or amendments to SEADIP." [This condition is similar to what Lyon proposed at a December 20, 2011 Council meeting on the 2nd/PCH project (at which the Council voted 3-5 (Johnson absent) against the 2nd/PCH project as then proposed)]. Ms. Bodek's memo adds: "In addition, Lyon raised two related issues that will need to be resolved as part of this process. One is to have any outstanding Tideland funding issues prior to starting the process, and two, is determine the best course of action related to the City owned parcel adjacent to the existing office buildings at the Marketplace." [We presume that latter reference pertains to what's now called (by wetlands advocates) the "Marketplace Marsh," which is the property formerly owned by a Tom Dean-LLC and acquired by the city in a swap for other city property. LB city officials have previously indicated they plan to have the Los Cerritos Wetlands Authority purchase the property from the city.] Ms. Bodek's memo indicates that if the city is not successful in obtaining grant funding, or private funding from Lyon, "it will need to seek alternative sources of funding." Her memo adds that the SEADIP update process "will be rife with controversy and conflict as staff attempts to balance the needs and desires of all affected stakeholders."
