Proposed CA Law, Poised For Full State Senate Vote, Would Require Microchipping Pets Claimed Or Adopted From Animal Shelters: Council Committee Today (May 31) Considers Recommending Council Position On Bill...Although Senate Analysis Says LB City Hall Already Supports It

(May 31, 2011) -- A bill introduced by state Senator Ted Lieu (D., southbay) that would require owners of an animal claimed or adopted from a shelter to implant a microchip in their animal upon release is poised for a full state Senate vote as soon as today (May 31) or in the coming days.

Later today (May 31) at 3:30 p.m., the LB City Council's State Legislation Committee (O'Donnell, Johnson, Garcia) will consider whether to recommend full Council support for the measure...although a state Senate legislative analysis already lists the City of Long Beach as among the bill's supporters.

SB 702, carried by state Senator Ted Lieu (D., southbay), would require an owner of an animal that is adopted or impounded and claimed by the owner from a local animal shelter to implant an identifying microchip in the animal upon release, if a microchip is available. (If a microchip is not available, the owner would be require to implant a microchip within 30 days).

A state Senate legislative analysis includes a list (compiled May 17) indicating the City of Long Beach supports the measure...along with Social Compassion in Legislation (bill source), Animal Legal Defense Fund, California Animal Control Directors Association, Humane Society of the United States, Santa Cruz Society for the Prevention of Cruelty to Animals and Take Me Home Animal Rescue

SB 702 is opposed by the California Responsible Pet Owners' Coalition (whose website states that the group was "founded by a group of like-minded animal lovers to fight oppressive anti-animal legislation in the State of California. Our founding supporters include pet owners, rescue volunteers, working dog owners, service and therapy animal owners and clients, trainers, veterinarians, as well as show cat and dog breeders and enthusiasts.")

From the Senate legislative analysis of SB 702:

ARGUMENTS IN SUPPORT: Social Compassion in Legislation supports this bill stating that microchipping is a safe and effective way to ensure that animals are returned to their owners.

In support, the bill's sponsor cites the American Veterinary Medical Association's Web site, which gives reasons why other methods of identifying lost animals are not as effective. According to the Web site, "tattooing animals is undesirable because it can produce discomfort and also fade with time or can be altered. Ear tags are effective and visible means of identification, but can be removed intentionally or by trauma. Hot branding provides permanent identification of livestock, but it elicits a marked pain response followed by local inflammation and increased skin sensitivity for one week." Additionally, studies have shown that where an animal was microchipped, it was successfully returned to its owner 74.1 percent of the time.

ARGUMENTS IN OPPOSITION : California Responsible Pet Owners' Coalition states that owners are reluctant to microchip their dogs because studies have shown, "When a dog is mircochipped, the site of implantation may become swollen or infected; the chip may fail or migrate in the animal's body; and tumors and cancers have developed at the site of implanted chips, necessitating amputation or worse." Additionally, they state that competitors often make their own scanners, which will not read another competitor's chips.

Sen. Lieu introduced and is carrying SB 702 at the urging of Social Compassion in Legislation, the group headed by Judy Mancuso that championed last year's SB 250 The Pet Responsibility Act, which sought to require stray dogs to be spayed or neutered while allowing allowing owners to keep unaltered dogs as long as the animals were licensed. That measure, supported by LB City Hall [and editorially supported by LBReport.com] passed the full Senate but failed passage in the state Assembly.
