    DA Files Three Serious Felony Charges -- But Not Hate Crime Charges For Now -- Against Each Of Ten Juveniles Allegedly Involved In Halloween Night Beating Of Three Women In Bixby Knolls Neighborhood


    (Nov. 7, 2006) -- LBReport.com has further developments regarding the Bixby Knolls beating of three women on Halloween night that LBPD has treated as a hate crime...but the L.A. County District Attorney's office -- for now -- has not.

    We also have some additional information about the Good Samaritan credited with stopping the attack, whom we mentioned in our initial report.

    LBPD has now confirmed to LBReport.com that the Good Samaritan who came to the aid of the three women while they were being beaten is an African-American man. He is credited with effectively stopping the attack and preventing the victims from suffering even further injuries. LBPD has declined to identify him thus far.

    As previously reported by LBReport.com, the three female victims (one age 19, two age 21) were walking at about 9:15 p.m. in the 3800 block of Linden Ave in the area of a neighborhood "haunted house" when they encountered a group of individuals who allegedly hurled racial taunts at them (in the nature of "white bitches" or similar, LBPD previously indicated).

    Following the racial taunts, members of the group allegedly began beating the three women, inflicting severe injuries sufficient to involve hospital treatment.

    The three victims are White; the juvenile alleged assailants are Black; LBPD has said it believes the attack was unprovoked and it has treated what occurred as a hate crime.

    However the L.A. County District Attorney's office tells LBReport.com that it has NOT filed hate crime charges against the juvenile alleged assailants at this point.

    The DA's office did, however, file three serious felony charges against each of the alleged assailants of assault with intent to inflict great bodily injury.

    DA press secretary Jane Robeson indicated the DA's office hasn't filed hate crime charges at this time because while some words were allegedly spoken, the DA's office would have to show that the specific juvenile(s) charged is the person who spoke them.

    Asked if the circumstances surrounding the beating itself would be sufficient to infer a hate crime, press secretary Robeson said no...the hate crime charge would involve linking words specifically spoken by the juvenile(s) charged to show a racial or hate crime motivation for the attack.

    DA press secretary Robeson said that if more evidence comes to light, it will be considered and the case remains under investigation.

    LBReport.com has also learned additional information about the arrest of the ten juveniles...whom LBPD took into custody the same night as the attack.

    LBPD Public Information Officer Sgt. David Cannan says that following the beatings, LBPD's helicopter spotted a suspect vehicle. LBPD patrol officers responded, detained ten suspects and found evidence allowing officers to take the suspects into custody and book them.

    Because the alleged assailants now charged are all under 18, their fate won't be decided by a jury but by a judge. As in every criminal case, the DA has the burden of proving each and every element of the offense charged beyond a reasonable doubt and the alleged assailants are entitled to the presumption of innocence.

    If the court finds them guilty of the offenses charged, their punishment(s) could range from probation through the CA Youth Authority and could be from a few months to age 25.
