(Nov. 11, 2016, 1:15 p.m.) -- Under the CA Public Records Act, LBREPORT.com requested a copy of the document (believed to be a survey, report or the like) publicly referenced by city staff during the Nov. 1, 2016 City Council meeting in representing that the Queen Mary requires over $200 million in repairs. In our Records request, we also invited any statement that the City believes is relevant (context, additional information) for publication on the matter.

We publish below the response provided by Assistant City Manager Modica. We webposted and linked to the document indicated as attached to his email response:

[Ass't City Mgr. Modica text] The City received one hard copy of an advanced draft version of the Queen Mary Marine Survey. The Urban Commons team briefed our leasing and engineering staff on the report as part of our lease negotiations, to ensure there was justification for public investment in the City’s asset. After the briefing, the City had a chance to review the draft report, and returned it to Urban Commons/Evolution as it was a draft document. The document is not in the City’s possession. The City does have a final list of $23 million in improvements that public funds would be spent on, and a copy of that document is attached. Additionally, the Marine Survey is a privately-commissioned draft document that is not yet complete. Urban Commons has told us that they expect it to be complete within 30 days and we will make it available as soon as the City has received a final copy.

On Nov. 10 (6:10 p.m.) PressTelegram.com reported that it had requested the document under the Public Records Act and indicated that the City declined to provide it.

At the Nov. 1 City Council meeting, Councilmembers voted 6-1 (motion by Pearce, Price dissenting, Richardson and Gonzalez in China) to approve a new 66 year lease for new QM lessee/operator/developer Urban Commons. The agendized city staff report indicates that the lease includes City-spending of up to $23 million in "up-front" to fund immediate ship repairs using $17.2 million (from a total $19 million) debt bond and pledging nearly $6 million in Tidelands funds to back up the debt-bond if anticipated revenue from the city's lessee (Urban Commons) and sub lessee (Carnival) doesn't materialize as planned. The Council declined to agree to a request by 3rd dist. Councilwoman Suzie Price to give City Auditor Laura Doud 14 days (Price initially sought 30 days) to review the proposed transaction.
