    Recall Revived! 11-Judge Appeals Panel OK's Proceeding With Oct 7 Election & ACLU Won't Appeal To U.S. Supreme Court May Be Next


    (Sept. 23, 2003, updated 11:45 a.m. from initial post 9:02 a.m.) -- An 11-judge panel of the 9th district U.S. Court of Appeals has unanimously OK'd proceeding with the Oct. 7 gubernatorial recall election.

    The en banc appellate panel reversed a Sept. 15 three judge appellate ruling that had blocked the Oct. 7 special election.

    [update 11:40 a.m.] Reuters reports that the ACLU has indicated it will not appeal the decision to the U.S. Supreme Court.
