(January 11, 2021, 1:05 p.m.) -- House Democrats have given VP Mike Pence (who defied President Trump and refused to stop an Electoral Vote count) an ultimatum: either agree to invoke the 25th Amendment to declare President Trump unfit to remain in office -- text here -- OR roughly 200 House Dem co-authors (to date) will advance a House resolution -- text here -- making President Trump the first president in US history to be impeached twice by the House. Earlier today (Jan 11) House Repubs blocked unanimous consent to the House 25th Amendment resolution meaning it will be voted on by the full House on Tues. Jan. 12. If VP Pence declines to invoke the 25th Amendment, Dems will likely vote for the impeachment resolution on Wednesday Jan. 13.

The impeachment resolution states in pertinent part:

President Trump gravely endangered the security of the United States and its institutions of Government. He threatened the integrity of the democratic system, interfered with the peaceful transition of power, and imperiled a coequal branch of Government. He thereby betrayed his trust as President, to the manifest injury of the people of the United States. Wherefore, Donald John Trump, by such conduct, has demonstrated that he will remain a threat to national security, democracy, and the Constitution if allowed to remain in office, and has acted in a manner grossly incompatible with self-governance and the rule of law. Donald John Trump thus warrants impeachment and trial, removal from office, and disqualification to hold and enjoy any office of honor, trust, or profit under the United States.

The 25th Amendment that the House wants VP Pence to invoke (to avoid impeachment by immediate removal) was passed by Congress July 6, 1965, ratified February 10, 1967. It states in pertinent part:

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.

Thereafter, when the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that no inability exists, he shall resume the powers and duties of his office unless the Vice President and a majority of either the principal officers of the executive department or of such other body as Congress may by law provide, transmit within four days to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office. Thereupon Congress shall decide the issue, assembling within forty-eight hours for that purpose if not in session. If the Congress, within twenty-one days after receipt of the latter written declaration, or, if Congress is not in session, within twenty-one days after Congress is required to assemble, determines by two-thirds vote of both Houses that the President is unable to discharge the powers and duties of his office, the Vice President shall continue to discharge the same as Acting President; otherwise, the President shall resume the powers and duties of his office.

Dems have held a House majority since 2018 and with Speaker Nancy Pelosi (D. SF) signaling her support, as a practical matter there's little Repubs can do to stop a House impeachment vote if VP Pence declines to invoke the 2rt5th amendment.

The Senate -- in which Republicans will lose majority control when two Dem Senators, elected by Georgia voters, will take office hortly] -- has adjourned and isn't scheduled to reconvene until Jan. 19 when it could hear an impeachment resolution, ultimately including a Senate trial on the House charges.

President Trump's term of office expires by its terms on Jan. 20 at noon eastern time.
