(June 18, 2021) -- LBREPORT.com has learned that materials sent on or about August 3, 2020 to the L.A. County District Attorney's office by "Grassroots for 2nd District Accountability" that alleged (with 41 attached exhibits) voter registration fraud by then CD 2 Council candidate Cindy Allen for having registered to vote and voting in Long Beach while allegedly living in OC remain "under review."
As of November 4, 2020 the matter was under review by then-District Attorney Jackie Lacey's office. In a June 17 email, DA spokesperson Greg Risling told LBREPORT.com that the matter remains under review [under L.A. County DA George Gascón who took office in early December, 2020.] The response means the DA's office hasn't closed the case (on allegations brought by an individual who admittedly supported then-November 2020 ballot opponent Robert Fox) nor has it alleged any wrongdoing by Councilwoman Allen who has denied the allegations. Voter registration issues, seemingly simple on initial examination, can be legally and factually complex. They require enforcement agencies to compare the specific facts involved to the applicable law. Allegations of voter registration fraud don't automatically prove themselves. Under CA law, voters must register at the address where they maintain their "domicile," requiring a sometimes complex analysis. The CA test for establishing a lawful voter registration "domicile" includes not only where "habitation is fixed, wherein the person has the intention of remaining" but also, in the case of multiple residences, where one "maintains a homeowner's property tax exemption." (An exception applies if one has a differing registration address "listed...on any driver's license, identification card or vehicle registration.") |
Ms. Allen said she lives and has lived for several years in the downtown LB condo, cited the LB City Clerk's decision deeming her qualified as a ballot candidate (based on residing in LB for at least 30 days before the election) and shrugged further questions from media outlets and others pursuing details. At one point she walked out of a neighborhood group's webstreamed candidate forum when asked about the matter. Backed by major spending by the leadership of the LB Police Officers Ass'n (union) political action committee and endorsed by nearly all Long Beach elected incumbents, Allen outpolled Fox was elected in a November 2020 runoff.
Councilwoman Allen was recently named (with no other LB Councilmembers expressing an interest) to fill a vacancy as one of LB's two representative on the Southern CA Ass'n of Government's (SCAG) policy setting Regional Council. (The other is LB Vice Mayor Rex Richardson, who in 2020 advanced to a one year position as SCAG President.)
In 2014, then-LB area state Senator Rod Wright was prosecuted for filing a false declaration of candidacy, voter fraud and perjury in connection with his voter registration when he ran for the state legislature. Sen. Wright raised legal and factual issues in strongly denying the charges but was convicted and required to forfeit his state Senate seat. The state legislature subsequently amended the state law to clarify claimed ambiguities. In Nov. 2018, then-Governor Jerry Brown pardoned Wright.
