(Sept. 25, 2020, 4:45 p.m.) -- Cindy Allen's campaign complaint against Robert Fox, submitted to the LB City Prosecutor, the LA County District Attorney and the Fair Political Practice Commission, is an unsworn unsigned 26 page narrative, composed by the Allen campaign based on/accomnpanied by multiple pages of documenting emails/texts/communications to/from the Fox campaign

Ms. Allen's campaign chose not to send LBREPORT.com materials it first sent to the PressTelegram (So Cal News Group corporate chain) and the LBPost. (owned/operated by Pacific6 subsidiary) The two publications reported their versions of the story on Sept. 22 and Sept. 24, respectively. In response to a Sept. 24 request by LBERPORT.com to Ms. Allen, the campaign swiftly sent us what her campaign sent our competitors. Here's what we found.

  • The document the PT and LBPost.com described as a complaint is a 26 page unsigned unsworn narrative. Its text indicates it was prepared by the Allen campaign, Rxactly who prepared it and submitted it isn't indicated, The narrative cites as its source an individual it describes "a key member of the Robert Fox Campaign." The Fox campaign denies that the individual had such a role. The narrative attaches photographs, emails, texts and other internal Fox campaign related materials provided by the individual. They document contacts with but not explicit direction or control over the individual's actions by the Fox campaign.

  • The narrative cited internal materials it says show the Fox campaign created "a smear campaign against Cindy Allen called 'Operation AllenTown'.and says many of its tactics "are illegal and fraudulent..." Accompanied by texts, photo, screen waves, the narrative alleges [section headings] "Fake and Fraudulent Accounts set up by Robert Fox:," "Stalking and Violation of Privacy" and "Unauthorized Spying/Video."

  • The Allen campaign narrative attempts to discredit Beachcomber journalist/columnist Steve Downing, alleging he's "actively coordinating with the Fox campaign. ("Mr. Downing told The Fox campaign that as a former Police Chief that he could run plates of all of Ms. Allen’s neighbors." The narrative includes photos of vehicle license plates but no documents substantiating Mr. Downing's alleged role.) The narrative also alleges Mr. Downing printed "information he knows to be false, and "has also donated to the Fox campaign."

    Asked about the license plate issue by LBREPORT.com, Mr. Downing denied running license plates or asking anyone else to do so.

    In a Sept. 24 open letter to Ms. Allen in the Beachcomber online, Mr. Downing asks her to provide "proof for the statement made to the City Prosecutor and LBPost.com about his "so-clled coordination with the Fox campaign." In its Sept. 24 story on the Allen-campaign narrative, LBPost.com notes "Downing has denied any coordination with the Fox campaign."

Mr. Downing, a frequent critic of LBPD and LB police union actions, bylined the Feb. 2020 Beachcomber story that revealed Ms. Allen's purported sale of her ETA Agency (an entity with City of LB contracts) prior to her Oct. 2019 Council candidacy announcement was in reality a third party press release-announced conveyance to a bogus entity. The article also questioned Allen's residencey address for voting and candidacy purposes. Both issues have continued to dog Ms. Allen who has repeatedly stated that she resides in a downtown condo and not in a Fountain Valley residential property she owns. In August 2020, Ms. Allen indicated she has conveyed the ETA Agency to two other individuals.

Long Beach City Prosecutor Doug Haubert treated the Allen-campaign provided narrative as a complaint and issued the following statement.

It is not unusual to receive election-related complaints in the months leading up to an election. We take all complaints seriously. In each case we follow up to see if the complaint has merit, and if the conduct alleged is a criminal offense...

On or about September 18, 2020, the City Prosecutor's Office received a complaint regarding a number of acts which, if true, could violate state laws. The allegations are not Elections Code violations, but they focus on conduct by a candidate for Long Beach City Council seat and are in connection with that candidate’s campaign. This inquiry is still in the initial stages.

The importance of a fair and thorough investigation cannot be overstated. Not only is it crucial to ensure that those violating the law are stopped, but it is also extremely important that we focus on complaints that have real merit. We don't take any sides, we just follow the evidence to see where it leads. We have prosecuted election-related crimes in the past when a violation was clearly shown, and we will not hesitate to do so again.
