City Mgm't Seeks To Block Public Disclosure -- Sought by LBREPORT.com Under CA Public Records Act -- Of The Two Proposals Submitted For Civic Center Rebuild...Until After Contract Awarded

(June 12, 2014, 7:35 p.m.) -- In response to a CA Public Records Act request submitted June 6 by LBREPORT.com, Long Beach city management at late afternoon Thursday June 12 provided a response that attempts to withhold from public disclosure the two proposals submitted to the City by two management-pre-selected private developer/operator teams to finance, build, operate and maintain a new Civic Center in exchange for City payment of an annual escalating sum for roughly 40 years plus conveyance of developable land under the now-vacated former Long Beach courthouse under a "public/private partnership" (P3) transaction.

"The City does not disclose responses to Requests for Proposals until a contract has been awarded," states the response provided by a representative of the Long Beach City Manager's office. "We can withhold competitive proposals in accordance with section 6255 of the California Government Code, asserting that the public's interest served in not disclosing the proposals during the negotiation process outweighs the public's interest served by disclosure of the documents. During the process of analyzing proposals and subsequently, seeking the City Council's approval, the public is given an opportunity to participate and provide comments," city management's response states.

City management has previously indicated that based on its review of the two submitted proposals, it plans to bring forward its recommended choice of a preferred developer/operator at the July 1 City Council meeting at which an outgoing Council majority may take voted action. A new Council majority takes office on July 15.
